Domenica Saverino alleged that officers Nicholas Argentine and Joseph Fallon negligently failed to protect and supervise prisoner Robert Maday. Mr. Maday was being transported from a Kankakee Correctional Facility to court, when Mr. Maday escaped custody while they were working as state’s attorney investigators in Sept. 2009. During Maday’s escape, Defendant Robert Maday took hostage of the Defendant Investigators, forced Defendant Argentine to give him his pants, and stole one of their weapons and robbed a Kohls store. The following day Mr. Maday carjacked Plaintiff Domenica Saverino. Ms. Saverino subsequently sued Cook County, the State’s attorney’s office, the investigator defendants, and Robert Maday for various torts. The lawsuit was dropped after defense attorneys filed their motion to dismiss the case, arguing that Plaintiff failed to make out her negligence claim and that immunity applied as granted by state statute.
